These Terms and Conditions govern inquiries, complimentary print invitations, session bookings, and portrait services provided by Elite Sports Pictures. By submitting a form, scheduling a session, or attending a sitting, you agree to these terms.
SMS Consent and Privacy
By submitting a contact form on our website or a Facebook lead form, you authorize Elite Sports Pictures to send text messages with session information, scheduling details, and studio communications. Message and data rates may apply. Consent is not a condition of purchase.
No mobile information will be shared with third parties or affiliates for marketing purposes. Information may be shared with subcontractors who provide support services such as customer service, scheduling, or production.
Complimentary Print Invitation
From time to time, Elite Sports Pictures invites selected families to schedule a portrait session that includes one complimentary print with the session. This is an invitation to book a session. It is not a contest, raffle, sweepstakes, prize drawing, or gift certificate program.
Eligibility is limited to residents of Arizona, Alabama, Oklahoma, and Texas who are 18 years of age or older. Invitations are extended at the studio’s sole discretion. Submitting a form does not guarantee selection or a session.
A household may receive only one complimentary print invitation in any 12-month period, calculated from the prior sitting date. The complimentary print applies only to studio portraiture created at the invited session and may not be applied to other photography types, prior sessions, framing, or products from a different sitting.
The complimentary print has no cash value, is not transferable, is not exchangeable, and may not be combined with any other studio offer. Unused invitations expire if a session is not scheduled and completed within the timeframe stated in the invitation (or within 60 days if no date is stated).
Facebook and other platforms are not sponsors of this invitation process. Submitting a lead form on Facebook does not create any relationship with Meta or Facebook.
Appointment Holding Deposits
A holding fee / deposit is required to secure and hold your appointments. This fee confirms your commitment to the scheduled photo shoot and purchasing appointment.
The holding fee will be applied or refunded at your purchasing appointment if you complete both the photo shoot and the purchasing appointment at the scheduled times. Failure to attend or complete a scheduled appointment results in forfeiture of the holding fee and cancellation of any complimentary print included with that session.
There is a $150 penalty, billed immediately, for no-shows. If you cannot attend, notify the studio in advance. Advance notice avoids the no-show fee; the refundable booking fee is still forfeited if the appointment is cancelled.
Non-Transferable Offers
Complimentary print invitations are non-transferable. They cannot be sold, assigned, exchanged, or redeemed in whole or in part for cash. Only one complimentary print may be used per household per invited session. The complimentary print cannot be used toward products from any other photo session or toward framing.
Artistic Control
Elite Sports Pictures reserves artistic control over the design and content of each session. We may, at our discretion, decline to create certain types or styles of photography. We reserve the right to refuse to produce images at some sizes or combinations of sizes if we believe those images would be detrimental to our reputation as a professional studio.
Clients should discuss their requirements with the studio before the session.
Refusal of Service
Elite Sports Pictures reserves the right to refuse service if, in our opinion, providing service is likely to cause or has caused disruption to staff or to the normal operation of the business.
Whole Family Policy
Elite Sports Pictures reserves the right to refuse service if the entire family does not attend the photographic session. When applicable, both parents are required to attend the session.
Appointment Reschedule Policy
A complimentary print invitation entitles the holder to a single appointment only. Once made, an appointment generally cannot be rescheduled, and the invitation is treated as used in full at that original appointment date and time.
In exceptional circumstances, management may, at its sole discretion, reschedule an appointment and carry forward the complimentary print invitation and holding fee / deposit.
No-Show Policy
Non-attendance (no-show) at an appointment without notice results in forfeiture of the holding / deposit fee. The complimentary print invitation is then deemed used in full.
Extended Family Policy
Extended families are groups larger than eight people. Different prices apply; please contact the studio for a current quote. Extended family bookings are taken at the photographer’s discretion and require an in-studio consultation. Complimentary print invitations are not available for extended family sessions.
Copyright
Copyright in all images created during the photo shoot belongs solely to Elite Sports Pictures. Clients receive usage rights only as stated on the signed agreement or order form.
Refunds
We are not required to provide a refund or replacement if you change your mind. Elite Sports Pictures stands behind our work. If you are not fully satisfied with your portrait, refer to the policy on your signed agreement / order form. Depending on the type of session, replacement portraits or studio credit may be awarded as deemed appropriate by the studio.
Disputes
These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute arising out of or connected with these terms, a session invitation, or studio services shall be resolved individually, without class action, exclusively in a court of competent jurisdiction located in McClain County or Cleveland County, Oklahoma.
You waive any right to punitive, incidental, or consequential damages and to multiplied or increased damages, except for actual out-of-pocket costs directly related to the booking at issue.
